Illegal CashApp Giveaway

Hosting a sub only cash giveaway not only breaks the Twitch TOS but is also illegal in the US. It happened on Trainwrecks’ Scuffed Podcast when he began to distribute cash to subscribers via his sponsors Cash App. A clip of the podcast over on Reddit shows Trainwrecks under the Just Chatting category with the title SUBS ONLY GIVEAWAY.

It shows him appearing to run what is basically an illegal sweepstakes event. The guests on his podcast, including Tfue, xQc, and ManuelFerraraTV shout out numbers before Trainwrecks declares “LosPollos and Nickmercs, $45k to the chat!”. Hosting competitions for subs only is not only against Twitch’s TOS but also against the law. This is because subs only giveaways are considered to be lotteries, as entry is blocked by a paywall. In this case it was the cost of a subscription, and as such fell under strict legislation. Trainwrecks’ channel is still live and what appears to be the VOD of giveaway stream is listed as only available to subscribers. Now viewers are waiting to see if Trainwrecks is held accountable for his actions.
